TERMS & CONDITIONS OF SALE
1. Purpose
These Terms & Conditions govern the mountain bike guiding, coaching and instruction services provided by MonTagne Bike Guiding.
2. Nature of Services
MonTagne Bike Guiding provides exclusively:
Guiding services
Sports supervision
Technical instruction
Unless expressly stated otherwise in writing, services do not include:
Accommodation
Meals
Equipment rental
Such services may be suggested but are contracted and paid directly by the Client to third-party providers.
3. E-MTB Services – EPAC Category 1
E-MTB services are strictly limited to EPAC / Category 1 electric bicycles, defined as:
Pedal-assist only
Maximum continuous rated motor power: 250 watts
Assistance cut-off above 25 km/h
Any non-compliant bicycle may be refused without refund.
4. Participation Conditions
The Client declares that they:
Are in good physical condition
Have the required technical level
Wear a helmet (mandatory)
Strictly follow the guide’s instructions.
5. Client Equipment – Responsibility & Compliance
The Client is solely responsible for the equipment used during services provided by MonTagne Bike Guiding, whether a conventional mountain bike or an electric mountain bike.
When using an electric mountain bike, the Client must ensure it qualifies as an EPAC / Category 1 bicycle under applicable European regulations.
The Client guarantees that their equipment is legally compliant, well-maintained, in proper working condition and suitable for mountain terrain.
Any modification, alteration, derestriction or non-compliance excludes the bicycle from the EPAC category and remains the Client’s sole responsibility.
MonTagne Bike Guiding does not perform exhaustive technical inspections of personal equipment and shall not be held liable for consequences resulting from:
regulatory non-compliance,
poor maintenance, wear or improper adjustment,
voluntary or involuntary technical modification,
unsuitability of the equipment to the Client’s level or terrain conditions.
In the event of clear non-compliance or safety risk to the Client or group, MonTagne Bike Guiding reserves the right to refuse or terminate participation without refund.
The Client acknowledges that use of non-compliant equipment may result in civil, criminal and insurance consequences and accepts full responsibility.
6. Guide’s Sole Decision Authority (SAFETY)
For safety reasons, the guide has sole and final authority regarding:
route selection,
pace and progression,
programme adaptation,
partial or total interruption of the service.
Such decisions may be taken in particular due to:
adverse weather conditions,
terrain conditions,
insufficient technical or physical level of one or more participants,
inappropriate behaviour or failure to follow instructions,
any identified risk to the Client or group.
These decisions shall not give rise to any claim, compensation or refund.
7. Insurance
MonTagne Bike Guiding is covered by Professional Civil Liability Insurance provided through the MCF (Moniteurs Cyclistes Français).
8. Applicable Law
These Terms & Conditions are governed by French law.
Any dispute falls under the exclusive jurisdiction of French courts.
